Terms and Conditions
1. Our contract
All bookings are made with Side Street Explorers. By booking a tour with us you are agree to these Booking Conditions (which constitutes the entire agreement between you and us). The services to be provided are those referred to in your booking confirmation and/or invoice.
Dates and itineraries are valid for set departure date in 2019 and 2020, thereafter dates and itineraries are an indicative price. Tour packages are valid for International and South African citizens. Child prices are available on request as they differ from tour to tour.
3. Deposit requirement
A non-refundable deposit of 10% of the total package price is payable to secure a booking. Once 10% deposit is received, flight bookings will be made and confirmed. Once confirmation of flights is received you will need to pay the flight portion of the package within 24 hours. Final payment will be due 90 days prior to departure.
If you book within 90 days of travel, 50% non-refundable deposit is due within 24 hours and final payment is due within 60 days.
4. Acceptance of booking and final payments
On acceptance of your booking Side Street Explorers will issue a confirmation invoice. A contract will exist between us from the date we issue the confirmation invoice or if you book within 90 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments. If payment is not received on or before the due date, we reserve the right to treat your booking as cancelled.

5. Prices & surcharges
Our tour prices are subject to variable exchange rates and seasonal pricing. This means our tour prices may vary at any time in accordance with demand, market conditions, currency fluctuations and availability. Your best option if you like the price you see is to book and pay immediately. If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply. Side Street Explorers reserve the right to impose surcharges up to 90 days before departure due to, currency fluctuations, increases in airfare and/or taxes or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. Air Passenger Duty is included in the price of your air inclusive tour.
6. Your details
For us to confirm your travel arrangements you must provide all requested details as per the Side Street Explorers booking form. Necessary details vary by tour; they include but are not limited to full name as per South African Identify documents or passport, date of birth and any pre-existing medical conditions you have which may affect your ability to complete the tour. Indemnity forms if so, required by our destination management companies will need to be completed.
7. Cancellation by the Traveller
If you cancel some or all portions of your booking cancellation fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation. If you cancel a tour:
90 days or more prior to departure, we will retain the non-refundable deposit;
between 61 and 79 days prior to departure, we will retain the deposit or 50% of the total booking cost; whichever is greater, and
60 days or less prior to departure, we will retain 100%.
Different cancellation conditions, including higher charges apply to some tours or elements thereof. Cancellation terms and conditions on your invoice supersede the standard terms and conditions.
A Side Street Explorers consultant will advise if differences apply. You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation fees. If you leave a tour for any reason after it has commenced, we are not obliged to make any refunds for unused services. If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation fees are calculated on the full tour price.
8. Cancellation by us
Side Street Explorers may cancel a tour at any time up to 60 days before departure, subject to clause 13. Side Street Explorers may cancel a tour at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it believes is unsafe for our passengers to travel. If Side Street Explorers cancels your tour, you can transfer amounts paid to an alternate departure date or receive a full refund less the non-refundable 10% deposit. In circumstances where the cancellation is due to external events outside our control refunds will be less any unrecoverable costs. Side Street Explorers are not responsible for any incidental expenses that you may have incurred because of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.
9. Booking amendments
Amendments to any arrangements made in conjunction with your tour will incur a R1500 administration fee per booking per change. This fee is in addition to any charges levied by hotels, ground operators or airlines. No amendments are permitted to your booking within 30 days of departure.
The land price of your tour includes:
All accommodation as per the itinerary.
All transport listed in the selected itinerary.
Sightseeing and meals as listed in the selected itinerary.
The services of an Expert group leader as described in the selected itinerary. (Set Departure Experiences)
Airfares as stipulated in your tour itinerary.
The land price of your tour does not include:
International or internal flights unless specified in your tour itinerary
Airport transfers, taxes and excess baggage charges unless specified in your tour itinerary
Meals other than those specified in your selected tour itinerary
Visa and passport fees
Optional activities and all personal expenses
12. Age & Health requirements
Depending on your tour of choice, health requirement waivers may need to be signed in conjunction with the standard booking form.
Please note Side Street Explorers cannot guarantee twin or adjoining rooms for families; accompanying adults may be required to share with others in the group on a twin share basis.
Maximum Age: The majority of our tours Side Street Explorers have no upper age limit though we remind you that our tours can be physically demanding, and passengers must ensure that they are suitably fit to allow full participation.
14. Small groups & combination tours
‘Experience Tours’ are guaranteed to depart once they have four fully paid travellers unless minimum group size specifically states otherwise. Side Street Explorers can have groups with small numbers of travellers. If minimum numbers for specific tours are not met, Side Street Explorers reserves the right to add a surcharge.
‘Packaged Tours’ are guaranteed to depart once they have two fully paid.
15. Passport and visas
You must carry valid passport and have obtained all of the appropriate visas, permits and certificates for countries which you will visit during your tour. Side Street Explorers are not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.
16. Travel insurance
Travel insurance is mandatory for all our travellers and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. Side Street Explorers also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. Side Street Explorers are able to offer travel insurance as part of the package, or you must provide proof of your travel insurance, you will not be able to join the tour without it.
You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each tour is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
18. Change of itinerary
While Side Street Explorers endeavour to operate all tours as described we reserve the right to change the tour itinerary. Please refer to our website before departure for the most recent updates to your itinerary.
Before departure: If Side Street Explorers make a major change, we will inform you as soon as reasonably possible. A major change would be if there is a change that affects one day out of the itinerary; however, we will endeavour to reschedule the tour to include all inclusions as per the itinerary.
After departure: Side Street Explorers reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances, Side Street Explorers will endeavour to accommodate clients at the same or similar standard of the purchased tour.
19. Limitation of liability
Side Street Explorers contract with a network of companies, government agencies and individuals to assist in the running of our tours as agent for these third parties. Side Street Explorers are not responsible for the acts and omissions of these third parties.
To the fullest extent permitted by law:
- any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a tour, or any breach of the Booking Conditions, is excluded;
- you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a tour; and
- any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.
To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (i) the provision of a similar tour to an equivalent value; or (ii) a refund of the total amount received by us from you in connection with your booking.
Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.
20. Optional activities
Optional activities that are over and above what is included in the itinerary price, do not form part of the tour or this contract. The contract for the provision of that activity will be between you and activity provider, unless you have specifically requested Side Street Explorers to add it to your itinerary.
21. Claims & complaints
If you have a complaint about your local representative, please contact the local representation management in order that they can attempt to rectify the matter. If satisfaction is not reached through these channels then any further complaint should be put in writing to us within 30 days of the end of the tour.
In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.
24. Applicable law
The laws of South Africa fully govern these Booking Conditions as allowed. Any disputes in connection with a tour or these Booking Conditions must be initiated in the courts of Johannesburg, South Africa.
